Speedlane System Privacy Policy

Introduction

Speedlane LLC ("Speedlane" or "We") respect your privacy and are committed to protecting it through our compliance with this policy.

This policy describes the types of information we may collect from you or that you may provide when you visit the website speedlane.ai (our "Website"), including use of any of our web-based services, or use Speedlane Technology (collectively, the Speedlane System) when visiting our business partners, and our practices for collecting, using, maintaining, protecting, and disclosing that information. Speedlane Technology refers to systems, software, and hardware, provided and operated by Speedlane, that enhance consumer experiences for ordering and payment with one of our business partners, which may include restaurant and retail companies, such as by taking consumer orders using voice recognition and stored user profiles.

This policy applies to information we collect:

  • On this Website or when using our web-based services.
  • In email, text, and other electronic messages between you and this Website.
  • When you interact with Speedlane Technology installed or integrated with our business partners.

It does not apply to information collected by:

  • Us offline or through any other means, including on any other website operated by Speedlane or any third party (including our affiliates and subsidiaries).
  • Any third party (including our affiliates and subsidiaries), including through any application or content (including advertising) that may link to or be accessible from or through the Website.
  • In particular, this Privacy Policy does not apply to information collected from you by third parties, which may include restaurant and retail chain companies, payment processors, or other parties, even if we also collect the same or similar information from you.

Please read this policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, your choice is to not use the Speedlane System.

By accessing or using the Speedlane System, you agree to this Privacy Policy. The Speedlane System requires Personal Data in order to provide services to you, and so use requires acceptance of these terms. This policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of the Speedlane System after we make changes is deemed to be acceptance of those changes, so please check the policy periodically for updates.

Children Under the Age of 18

The Speedlane System is not intended for children under 18 years of age or other individuals without the legal capacity to accept this Privacy Policy. No one under age 18 may provide any information to or on the Speedlane System and may not register as a user. We do not knowingly collect or retain personal information from children under 18. If you are under 18, do not use or provide any information to the Speedlane System, register to use the Speedlane System, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete that information. The Speedlane System Collection, Use, and Retention of Data.

  1. What is Personal Data?

    When we refer to “Personal Data” in this Policy, we mean information that identifies, relates to, describes or is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to a specific person. Please see the information below for more details about the categories of Personal Data we collect in connection with the Speedlane System.

    Personal Data does not include public information that is lawfully made available to the public. Additionally, Personal Data does not include information that is deidentified or aggregated in a way that it cannot be used to identify a particular consumer or household (“Deidentified Data”). We commit to maintaining Deidentified Data in its deidentified form and not to attempt to reidentify the Deidentified Data, except and solely for the purpose of determining whether our deidentification process satisfies the requirements of applicable law. We may use, share, disclose, and maintain Deidentified Data without restriction.

    “Guests” refers to users that may interact with the Speedlane System without conducting a transaction using the Speedlane System. “Registered Users” refers to those users that have conducted a transaction using the Speedlane Website and so accepted the Terms of Use of the Speedlane System, whether they have registered with us directly, through use of our Website, or through one of our business partners. Some of the terms described below vary between Registered Users and Guests. Note that if you are not accessing the Speedlane System or Website using a device that has previously used the Speedlane System or a browser that recognizes your previous interactions, you will be regarded as a Guest, not a Registered User.

  2. What Personal Data Do We Collect?

    Depending on how you access, use or interact with the Speedlane System, we may collect the following categories of Personal Data about you. We have collected or shared the following categories of personal information in the past twelve (12) months, or intend to collect or share such information based on your use of the Speedlane System:

    Sensitive Personal Data may include Protected Health Information as that term is used in HIPAA, which includes any information, including demographic data, that relates to an individual’s physical or mental health or the provision of or payment of health care, which identifies the individual.

    We may also collect other personal information outside of these categories instances where you interact with us in-person, online, or by phone or mail in the context of:

    • Receiving help through our customer support channels;
    • Delivering information or services at your request; and
    • Facilitation in the delivery of our services and to respond to your inquiries.

    We will not collect additional categories of personal information or use the personal information we collected for materially different, unrelated, or incompatible purposes without providing you notice.

  3. What are the Sources of Personal Data We Collect?

    A large portion of the Personal Data we collect about you is collected directly from you through your access to, use of, or interaction with the Speedlane System. When you interact with the Speedlane System, we may automatically collect some Personal Data, including some identifiers, to determine whether you are a Registered User or a Guest.

    You have the option not to provide any Personal Data that we ask you to provide in order to become a Registered User, however, there are some features of the Speedlane System that can only operate if we have certain Personal Data. If you do not provide us with the necessary Personal Data, you will not be able to access, use or interact with that feature. This is especially true where it is impossible for the feature to operate without certain Personal Data. For example, without some specific Personal Data, it is not possible to provide customized resources to you or to complete sales and payment transactions. As another example, if you are a Registered User, we may be able to assist you in completing and paying for your transaction with one of our business partners, while this may not be possible for Guests. As another example, you may not be able to use the Speedlane Website without providing such Personal Data as to be a Registered User under this policy.

    We may collect Personal Data about you from third parties, including, without limitation, online and offline sources, our business partners, entities affiliated with us, our parent companies, our service providers, third party services, social media platforms, advertising networks and other public or commercial sources (collectively, “Third Party Sources”). The collection of Personal Data from these Third Party Sources can occur in a variety of ways, including, without limitation:

    • We may receive Personal Data about you from our business partners. The Speedlane System can help our business partners provide an enhanced, customized business transaction with you, and to do so, those partners may share Personal Data with us in order to facilitate these transactions or to enhance their (and our) relationship with you. If you are a member of a loyalty program affiliated with one of our business partners, we may receive Personal Data about you from that business partner in order to enhance your experience as a loyal customer.
    • We may receive Personal Data about you from third parties that provide services to us related to the functionality and operation of the Speedlane System, such as hosting the online portions of the Speedlane System and managing communications we send (collectively, our “Service Providers”).
    • When you interact with us on platforms or services owned or operated by third parties, including, but not limited to, any Social Media Sites (“Third Party Platforms”) we may receive Personal Data about you from those Third Party Platforms. As a result, we may share, store, use and otherwise process any Personal Data we receive from or in connection with those Third Party Platforms. Please note, we may now, or in the future, provide you with the ability to register for or sign into your account on the Speedlane System using an account you have on a Third Party Platform (instead of creating an account directly with us) and, if you do, that third party is included in this category.
  4. How Do We Use Personal Data?

    We may disclose your personal information with our service providers pursuant to a written contract between us and each service provider. Each service provider is a for-profit entity that processes the information on our behalf.

    We may use your personal information for our own business purposes, such as for undertaking internal research for technological development and demonstration. This is not considered to be "selling" of your personal data.

    We may collect Personal Data about you in connection with the Speedlane System for the following purposes, and make reasonable efforts to limit the use of your Personal Data to the minimum necessary to perform these purposes:

    • Customer Service and Customer Communications. We may use Personal Data to: (1) provide the features and functionalities of the Speedlane System you access, use or interact with; (2) send you communications to provide you with alerts and updates about your engagement with our services; (3) respond to your communications with us; and (4) carry out those purposes for which you authorize or instruct us to use your Personal Data.
    • Account Management. We may use the Personal Data of Registered Users to register and service your account on the Speedlane System.
    • Providing Services to You. The Speedlane System enables our business partners to receive and process orders and payments and to automatically provide you with the opportunity for customized interactions, purchases, and payment. We will use your Personal Data to identify you and to provide, or enable our business partners to provide, customized services and interactions to you. Your interactions with the Speedlane System will be influenced by the Personal Data you choose to provide and will be limited by the information you may choose not to provide. This use of your Personal Data is required for the Speedlane System to be able to provide the services you have requested through your interactions with the Speedlane System, and your use of the Speedlane System is expressly conditioned on your consent to this use of your Personal Data. Providing services to you may include providing your Personal Information to our business partners to customize or complete a transaction, using your Personal Information for payment processing on behalf of Speedlane or our business partners, providing you information and advertising regarding Speedlane and our business partners, and similar actions.
    • Business Purposes. We may use Personal Data for business purposes, including, but not limited to: (1) carrying out our obligations and enforcing our rights arising from any contracts we have entered into, including, but not limited to, any contracts between you and us; (2) operating and improving the Speedlane System; (3) conducting statistical or demographic analysis; (4) customizing your experience with our Speedlane System and our business partners; (5) preventing fraud; (6) marketing and promoting our Site; (7) fulfilling our commitments to our business partners; and (8) other business purposes permitted under applicable law.
    • Law Enforcement/Legal Purposes. We may use Personal Data to cooperate with law enforcement or other legal purposes: (1) complying with legal and regulatory requirements; (2) satisfying contractual obligations; (3) cooperatingwith law enforcement or other governmental agencies for purposes of investigations, public safety or matters of public importance when we are legally required to do so or believe that disclosure of Personal Data is necessary or appropriate to protect the public interest; and (4) protecting and defending against legal actions or claims.
  5. How Long Do We Keep Your Personal Data?

    We retain Personal Data only as long as we have a legitimate business purpose to keep it. These purposes may include retaining Personal Data to:

    • Complete the purpose for which the Personal Data was collected, including maintaining the Personal Data of Registered Users for future interactions between you and the Speedlane System and between you and our business partners;
    • Continue our ongoing business relationship with you, including to continue our business partners’ relationship with you;
    • Ensure the security and integrity of the Speedlane System; and
    • Satisfy any legal, regulatory, tax, accounting or reporting requirements.

    To determine the appropriate retention period for individual categories of Personal Data we collect, we consider the nature and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of the Personal Data, the purposes for which we process that Personal Data and whether we can fulfill those purposes through other means and applicable legal, regulatory, tax, accounting, reporting or other requirements.

  6. Who Do We Disclose Personal Data To?

    In order to operate and provide the Speedlane System and carry out other activities permitted by applicable laws, we may disclose certain Personal Data we have collected or received to certain third parties as described below. These disclosures are in addition to any disclosures to third parties you authorize or instruct us to make:

    • Our Business Partners: We may share your Personal Data, including Sensitive Personal Data, with our business partners, which may include restaurant and retail companies and payment processors, and we may receive compensation or other consideration for doing so. Our business associates have committed to exercising reasonable care to protect your Personal Data and may use your Personal Data to contact you to offer further services or support. In the past 12 months, we have disclosed personal data to our Business Associates for a business or commercial purpose.

    • Service Providers: We may disclose Personal Data to our Service Providers in connection with the services they provide to us, which may include, without limitation, data hosting and fraud protection and prevention. We require these Service Providers to exercise reasonable care to protect your Personal Data and restrict their use of your Personal Data to the purposes for which we provided it to them.

    • Third Party Platforms: We may disclose Personal Data to the applicable Third Party Platform as necessary to enable your ability to register and sign into the Speedlane System through the use of your existing account on the applicable Third Party Platform, including but not limited to our business partners’ loyalty programs. We may also disclose Personal Data to Third Party Platforms to perform data and statistical analysis about our operations and for marketing purposes.

    • Parties to Business Transactions: In the event of an anticipated or actual merger or acquisition, bankruptcy or other sale of all or a portion of our assets, we may transfer or allow third parties to use information owned or controlled by us, including Personal Data.

      We reserve the right, in connection with these types of transactions, to transfer, share, assign, or sell your Personal Data and other information we have collected to third parties or to authorize such third parties to use any such information including for due diligence as part of any of the transactions described in this paragraph. Any Personal Data you submit or that is collected after this type of transfer may be subject to a new privacy policy adopted by the successor entity.

    • Government and Law Enforcement: We may disclose your Personal Data to individuals or private parties where necessary to enforce and comply with the law, to protect our property or legal rights, for the safety of the public or any person, to prevent harm, to protect the security and integrity of the Services and any equipment used to make the Services available. This includes cooperating with the Department of Health and Human Services and the Office of Civil Rights with any audit or investigation into our compliance with relevant law.

    • Professional Advisors: We may disclose your Personal Data to our professional advisors, such as our attorneys, accountants, financial advisors, and business advisors, in their capacity as advisors to us.

    • Others: We may disclose your Personal Data to any other third party upon your request or with your express consent to do so.

  7. What Information Do We Collect Through Automatic Data Collection Methods?

    The Speedlane System uses voice recognition technology and other techniques to take and process your orders and provide other services to you. Your interaction may include payment processing through the Speedlane System, in which case details of your interactions, orders, personal identifiers, mobile device, payment methods, or other information may be automatically collected and stored in order to provide these services to you and to provide customized future interactions.

    Use of the Speedlane Website: As you navigate through and interact with our Website, including the use of a QR Code or other means to identify you or your order, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

    • Details of your use of our Website, which may include traffic data, location data, logs, and other communication data and the resources that you access and use on the Website.
    • Information about your computer or device and internet connection, including your IP address, operating system, browser type, mobile network information, MAC address, and the device's telephone number.
    • Location Information. The Speedlane System may collect real-time information about the location of your device in order to complete your purchase, payment, or other interaction with our business partners.

We also may use these technologies to collect information about your online activities over time and across third-party websites or other online services (behavioral tracking). Accessing and Correcting Your Information

California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia provide (now or in the future) their state residents with rights to:

  • Confirm whether we process their personal information.

  • Access and delete certain personal information.

  • Correct inaccuracies in their personal information, taking into account the information's nature processing purpose (excluding Iowa and Utah).

  • Data portability.

  • Opt-out of personal data processing for:
